WHAT IS PROBATE?
- Probate is the legal process through which the court sees that, when you die, your debts are paid and your assets are distributed according to your wishes. Probate in most cases is a public process that is open to potential creditors or disgruntled heirs to contest. It can take from a few months to possibly a few years to completely settle. During the probate process your heirs may be unable to access funds or property from your estate.
